GENERAL TERMS AND CONDITIONS



§ 1 General

operates an online shop (hereinafter referred to as “online shop”) at the URL https://www.dittrich-minden.de and the associated subpages. These general terms and conditions, in the version displayed at the time of the order, apply exclusively to all orders placed via the online shop as well as to deliveries and services provided by us. The online shop is designed for orders by consumers. Merchants are also welcome to place orders, but commercial resale of the purchased goods is prohibited.



§ 2 Cancellation policy for consumers within the meaning of § 13 BGB

Right of withdrawal for consumers
Consumers have a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you must inform us (DITTRICH GmbH & Co.KG, Immanuelstraße 3, 32427 Minden, Germany, email: shop@dittrich-minden.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You can use our sample withdrawal form for this purpose, but this is not mandatory. If you make use of this option, we will immediately (e.g. by email) send you confirmation of receipt of such a revocation.
To meet the revocation deadline, it is sufficient for you to send your notification of exercising your right of revocation before the revocation period expires.

CONSEQUENCES OF REVOKING

If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days of the day on which we receive notification of your revocation of this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us (DITTRICH GmbH & Co.KG, Immanuelstraße 3, 32427 Minden, Germany) immediately and in any case no later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. We will bear the costs of returning the goods. You will only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties, and functionality.

According to the law, the right of withdrawal does not apply, among other things, to: Contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

The right of withdrawal also expires in the case of: Contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.



§ 3 Prices, products and partial deliveries, partial revocation

The goods offered in the online shop are presented in the form of digital photographs based on the actual goods. Minor deviations between the presentation and reality do not constitute a defect in the ordered goods.
The products presented may no longer be available at the time of your visit to our online shop. We will inform you of this as soon as possible in a separate email. You can check the current status of your order

§ 3 Prices, products, and partial deliveries, partial revocation

The products presented may no longer be available at the time of your visit to our online shop. We will inform you of this as soon as possible in a separate email. You can view the current status of your order at any time via your customer account. We will inform you immediately in the event of delivery delays.
Furthermore, in rare cases, prices may be updated during the ordering process.
The prices quoted for the goods are in euros, including VAT and excluding shipping costs.
For deliveries to third countries, the prices quoted for the items are net prices, i.e., the sales prices excluding 19% VAT. The prices will be displayed excluding German VAT after you have specified your delivery country during the purchasing process. All additional costs for your order will be added to the total price immediately during the ordering process.
If you have a right of withdrawal in accordance with § 2 of our General Terms and Conditions, you can also exercise this right in part, i.e. return only certain goods from your order, provided that the respective goods have their own item number. In such a case, the delivery costs for the shipment will only be refunded to you to the extent that they were caused solely by the returned goods. If the delivery costs would have been incurred even if you had only ordered the goods for which you did not exercise your right of withdrawal, you must bear these delivery costs. Even in the case of partial revocation, delivery costs will not be reimbursed if you have chosen a different type of delivery than the cheapest standard delivery offered by us.

§ 4 Conclusion of contract

By submitting the order form in our online shop, you are making a binding offer to conclude a contract with us for the products ordered (“your contractual declaration”). You place the order by sending us the completed order form by clicking on the “Order now with obligation to pay” button. A contract between you and DITTRICH is concluded when we send you an acceptance by email within a reasonable period of time. If, contrary to expectations, you do not receive this, the contract is concluded when the goods are sent to you within the specified period.
Please note that you will receive confirmation of receipt of your order immediately after submitting it. This email is not an acceptance, but merely serves to confirm that we have received your order.
You can also place a binding order by telephone, email, or fax. An automatic confirmation of receipt of your order by email or fax does not constitute acceptance of the purchase offer.
DITTRICH is entitled to reject your order, in particular if there is reason to suspect that the goods purchased through our online shop are intended for commercial resale.

§ 5 Storage of the contract text

We store your order data. You will receive an email confirmation of your order, including cancellation policy, which you can print out or save.



§ 6 Delivery & shipping

DITTRICH ships your products within Germany via DHL Parcel. The transport risk is borne by the sender. Please note: If you specify a packing station as the delivery address, shipping is only possible via DHL.
The goods will be ready for shipment no later than the day after your order. Unless otherwise agreed with you, delivery from the warehouse will take place within 1-5 business days (see list below) to the delivery address you have specified, depending on the choice of shipping method and delivery location. Due to unforeseeable events, such as strikes, there may be delays in delivery in exceptional cases.
Shipping costs within Germany are free for orders over $750.00. For orders up to $749.99, the shipping fee is $7.99.
International shipping is a flat rate of $15.00 for all shipments and $10.99 for Austria and the Netherlands.
For partial shipments, shipping costs are only charged once.

 



4. Delivery to third countries, shipments subject to customs duties

For all deliveries to third countries, the prices quoted for the items are net prices, i.e., the sales prices excluding 19% VAT. The delivery time to countries subject to customs duties is two to four business days, depending on the shipping method and country of delivery. Please note that we bear the costs for door-to-door transport, insurance of the goods, and any costs for accompanying documents. For deliveries to non-EU countries, additional costs may also be incurred for which DITTRICH is not responsible and which must be borne by the customer. These include, for example, costs for money transfers by credit institutions (e.g., foreign bank charges, transfer fees, exchange rate fees) or import duties or taxes (e.g., customs duties or a capital commitment commission). Such costs may also be incurred in relation to the transfer of money if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union. Any import sales tax and import duties incurred will be invoiced separately to the recipient by the supplier (the respective partner carrier in the delivery area). Please note that in the event of a return, DITTRICH is not responsible for refunding any additional customs duties, import sales tax, or other processing fees that may be incurred.



§ 7 Payment, default of payment

When paying for your order at DITTRICH, you can choose between instant bank transfer, PayPal, and credit card, depending on the billing and delivery country.

Please note that some banks may charge separate fees for transactions from abroad, which you will have to pay. This is completely independent of DITTRICH and must be clarified with the respective bank in advance.

All payments and credits are processed in the currency used for the purchase (EUR). Refunds are made in the same currency as the purchase. DITTRICH accepts no liability for differences arising from exchange rate fluctuations. Any losses due to currency fluctuations will not be refunded.

Select instant transfer as your payment method:
Complete the order. You will be redirected to a secure payment form from Sofortüberweisung.
Log in with your online banking details (access data/PIN) as usual. Only transaction-relevant data is stored. Your PIN and TAN are not stored.
Confirm the order with a TAN.
Payment process for PayPal: You can pay securely and easily with PayPal. PayPal accepts payments up to a maximum purchase price of €8,000.

Select PayPal in the ‘Payment method’ step of the order process:
You will be automatically redirected to PayPal in the next step.
If you are already a PayPal customer, you can log in there with your user data and confirm the payment.
If you do not yet have a PayPal account, you can open one and then confirm the payment.
Complete your order with us by clicking on ‘PLACE ORDER NOW’ in the final step.
The goods will be ready for dispatch on the day of payment confirmation by PayPal or on the following working day at the latest and will be sent on their way. As a rule, we receive payment within a few minutes of the contract being concluded.
Credits from returns are always transferred back to the PayPal account used for the purchase. You can decide for yourself whether you want to continue using the credit on your PayPal account directly with PayPal or transfer it back to your checking or credit card account, and you can do this directly with PayPal. We have no influence on this.

 




Procedure for payment by credit card:

First, enter your credit card details in our SSL-secured payment form. SSL (Secure Socket Layer) is an asymmetric encryption method used on the Internet to protect your credit card details from interception and manipulation during transmission.
Please note that the cardholder must be entered as shown on the credit card. Please use only letters (a-z or A-Z) without special characters, numbers (0-9) or spaces.
After successful credit card verification by the credit card company, the invoice amount is first authorized, i.e., reserved on your credit card but not yet debited.
Your order will be processed within the delivery period specified in § 6.
The payment will be booked when the goods are shipped.

Additional security when paying with Visa, Mastercard, or American Express
The system checks whether the credit card participates in the 3-D Secure programs Verified by Visa, Mastercard SecureCode, or American Express SafeKey. These are encryption and security procedures developed specifically for these types of cards. If a credit card holder is registered for the 3-D Secure procedure via one of the registration methods, an additional query mask connected to your bank will open after the order has been completed, asking you to enter the “Secure Code” (a password chosen by you or a dynamic password that you will receive via SMS on your mobile phone after entering your credit card details). The transaction will only be carried out if the correct password is entered. If you are not registered but your card-issuing bank supports the procedure, you will be asked to create a 3-D Secure password. If your credit card or card-issuing bank is not registered for any of these procedures, the payment will be carried out without further authentication. Credits: Credits from returns will be refunded to your credit card.

The delivered goods remain the property of DITTRICH until full payment has been received.
If you are a merchant, you only have a right of retention or refusal of performance in the case of legally binding and undisputed counterclaims.
There is a maximum limit up to which purchase on account is possible. This limit applies to the entire customer account and also takes into account outstanding amounts from previous orders paid on account. DITTRICH reserves the right to demand advance payment in the amount of the order value, especially in cases where outstanding invoices are already in the dunning process at the time the order is received. The order will be processed after receipt of payment.

§ 10 Warranty / Guarantees / Reduction of Liability

The statutory warranty rights apply to ordered goods.
Insofar as DITTRICH provides a guarantee for certain properties
of the goods or for services through any information provided with the goods, DITTRICH shall be liable for this regardless of fault in accordance with the statutory provisions. Statutory deviations in favor of the customer only apply here if they are specifically noted for the respective goods.
DITTRICH shall be liable without limitation for intentional and grossly negligent conduct.
DITTRICH shall only be liable for slight negligence if essential contractual obligations are breached.
Essential contractual obligations are those obligations which, according to the meaning and purpose of the contract, the contract must grant to the customer or whose fulfillment is essential for the proper execution of the contract and on whose compliance you can regularly rely. Such liability is also limited to damage that was foreseeable at the time the contract was concluded and is typical for this type of contract.
The limitations or exclusions of liability under the preceding paragraphs (3) and (4) do not apply to any statutory strict liability of DITTRICH or liability arising from a contractually assumed guarantee, or in the event of injury to life, limb, or health.
Insofar as DITTRICH's liability is excluded or limited, this also applies to the personal liability of its legal representatives and vicarious agents. The limitations of liability also apply to all types of claims, including those arising from tort law.

 



§ 11 Copyrights

All rights to images, films, and texts published on our online shop are held by us or our partners. Any use, reproduction, editing, or storage without express consent or legal authorization is prohibited.



§ 12 Consumer information within the EU

Online dispute resolution platform: Under applicable law, we are obliged to inform consumers of the existence of the European Online Dispute Resolution Platform (ODR Platform), which can be used to resolve disputes without the need to involve a court. § 13 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
This choice of law does not apply if it would result in the consumer being deprived of the protection granted to them
protection granted to the consumer by the EU member state in which they have their habitual residence. In
this case, the law of the country in which the consumer has their habitual residence shall apply.
These general terms and conditions are available exclusively in German. A contract can only be concluded in German.
